Announcement of a Sole Source Purchase
Change Order
Published Thursday December 22, 2011
Vendor: Cyberonics, Inc.
Change Order Amount: $900,000

The purpose of this announcement is to modify the amount estimated at the beginning of the term. The University awarded a contract for VNS Therapy System/ NeuroCybernetic Prosthesis on 6/8/11 for a three year period in the estimated amount of $300,000. That amount was estimated based on historic expenditures. Actual expenditures are never predictable because they vary as a function of number of medical procedures that require the devices performed by the surgeons. Actual expenditures for fiscal year 2012 to-date have increased on account of an increase in surgical cases by a factor of 3. The Change Order amount represents revised projected spend for the entire initial 3-year term. This purchase remains economically available from a single source because the prosthesis is patented and is not available except from the holder of the patent. The device is the only device of its kind approved by the FDA for treating epilepsy.
The University award process may be delayed up to thirty days as this award goes through a state approval process.

The University awarded a contract for VNS Therapy System/NeuroCybernetic Prosthesis to Cyberonics, Inc., Houston, TX, for an estimated $300,000.
The therapy system is used to treat epilepsy through nerve stimulation. The product is a pacemaker-like device implanted under the collar bone with a lead attached to the vargus nerve. The device delivers intermittent signals to the brain, dubbed vargus nerve stimulation, to control epileptic seizures.
This purchase is only economically available from a single source because the item or service is copyrighted or patented and is not available except from the holder of the copyright or patent. This is a sole source because the therapy system is patented, and the device is the only device of its kind approved by the FDA for treating epilepsy.
