Comments:
Section 20-10(g) of the Illinois Procurement Code (30 ILCS 500/20-10(g)) provides that an award by competitive sealed bidding shall be made to the lowest responsible and responsive bidder whose bid meets the requirements and criteria set forth in the IFB except when an SPO determines it is not in the best interest of the State and by written explanation determines another bidder shall receive the award. The SPO has determined that it is in the best interest of the State to award to Rigaku Americas Corporation, a bidder that did not qualify as a responsive and responsible bidder because at the time it submitted its bid, the bid did not include the Iranian business operations disclosure required by ยง50-36 of the Code. A copy of the SPO's determination is attached.
The State Purchasing Officer for this procurement is now Stephen Rotello.
The University award process may be delayed up to thirty days as this award goes through a state approval process.
