Prohibition on Political Contributions

With the approaching election season, the Chief Procurement Office would like to remind vendors of the prohibition on political contributions found in Section 50-37 of the Illinois Procurement Code (30 ILCS 500/50-37). We encourage every vendor to be familiar with this section of the Code and to seek legal advice as to how this section affects your company.
The first day candidates may file nominating petitions with the State Board of Elections is November 25, 2013. As such, please be sure to check the up to date listing of declared candidates on the Board of Elections website.
Please note, in most cases contributions to the Governor and Lieutenant Governor as well as all other declared candidates for those offices are prohibited. In addition, contributions made by entities and persons affiliated with your business are also prohibited. For more information about which entities and persons are considered "affiliated" with your business please see the Business Registration FAQ available on the State Board of Elections website or the Illinois Procurement Code at Section 50-37 (30 ILCS 500/50-37) which is available on the General Assembly's website.
If you are unsure whether the prohibition on political contributions applies to your business, please refer to the Illinois Procurement Code at Section 50-37 available on the General Assembly's website.
Finally, please note if a vendor is found to violate this prohibition, all contracts between State agencies and that vendor are voidable. If a vendor violates this prohibition 3 or more times within a 36-month period, then all contracts between State agencies and that vendor are void.
Important Notice Regarding New Legislation

All State vendors should be aware of Public Act 98-107, effective July 23, 2013 (20 ILCS1005/1005-47). We encourage you to read the Act in its entirety.
This Act requires individuals or entities with contracts with State agencies under the jurisdiction of the executive branch, universities and community colleges to post certain employment vacancies on the the Illinois Department of Employment Security's website or to provide an online link to its employment vacancies so the link is accessible through Illinois Job Link website.
The requirement will only be applied with respect to a vacancy if the position requires the performance of services in Illinois or a state bordering Illinois.
This requirement does not apply to:
- contracts for construction-related services (e.g., design, planning, location and other studies)
- contracts for construction if the individual or entity has a contract with a bona fide labor organization for construction, or to
- contracts in effect as of July 23, 2013, (but will apply to renewals of those contracts if the contract is renewed after July 23, 2013).
